1.What the words mean
- We, us, ATA
- All Terrain Academy Limited, Isle of Man company number 135181C.
- You
- The person who makes the booking or buys the voucher. If you book for someone else, you are responsible for making sure they know these terms and follow them.
- Participant
- Anyone who drives, or rides in, one of our vehicles during an event. That includes you if you are driving.
- Experience day
- A Quarry Taster, Off-Road Experience, Half Day One-to-One or any other off-road driving session we sell to the public, including one redeemed with a gift voucher.
- Training course
- A professional 4x4, ATV, winch or bespoke course booked by or for an employer, with a certificate at the end.
- Team day
- A corporate or group event quoted and booked for a group.
- Event
- Any of the above.
- Voucher
- A gift voucher we issue for a named session, with an ATA-GIFT code and an expiry date.
- Spectator
- Anyone who comes to watch and does not drive or ride in a vehicle.
- The site
- Wherever the event takes place. For experience days that is normally South Barrule Quarry, a working government quarry we have access to.
- Meeting point
- Unit 9, Springham Park, Spring Valley Industrial Estate, Douglas, Isle of Man, IM2 2QU, unless we tell you otherwise in writing.
- In writing
- Email counts. Text messages and phone calls do not, unless we confirm them by email.
2.How a booking is made
- Sending a booking request through the website, by email or by phone is an offer to book. It is not yet a booking.
- When you request an experience day online, you select an available date and start time. The request is not a confirmed booking. We confirm the date and time in writing after receiving your deposit. If the deposit does not arrive within 48 hours of the request, we may release the time to someone else. A request for a day we have not opened is a preferred date only; we agree availability before asking you to pay. For voucher redemption, we check the voucher and availability, then confirm the date and time in writing.
- The contract between us is made when we send that written confirmation. It is made up of these terms, the booking confirmation, and the participant disclaimer you sign on the day.
- We can decline a booking request. If we do, we refund anything you have paid for it in full.
- When you tick the "I have read and agree" box on the website, we record the date, time, version of these terms and the network address the agreement came from. That record is our evidence that you accepted these terms.
3.Prices, deposits and payment
- Prices are in pounds sterling. Prices for experience days and vouchers include VAT. Training prices are shown excluding VAT; they are per candidate, and VAT is added to the quote and the invoice.
- A 50% deposit holds the date for an experience day, team day or training course. The deposit is non-refundable except where these terms say we will refund it (see sections 2.4 and 11).
- The deposit is paid by bank transfer, using your booking code as the reference. We do not take card payments online at the moment.
- The balance is paid as follows:
- Experience days: on the day, before you drive, by cash, card or bank transfer.
- Team days and training courses: by bank transfer at least 48 hours before the event starts, unless your quote says otherwise.
- Gift vouchers are paid in full by bank transfer. We issue the voucher once the money has arrived.
- If a deposit or balance is not paid when it is due, we may treat the booking as cancelled by you, and section 10 applies.
- If we made a mistake in a price on the website or in a quote, we will tell you before we confirm the booking and you can choose to go ahead at the correct price or cancel with a full refund.
4.Who can drive
- Every driver must hold a full driving licence: UK, Isle of Man, or an international licence or permit. Provisional licences are not accepted. You must bring the licence with you and show it to us before you drive. If your licence was issued outside the UK or Isle of Man, tell us when you book.
- You must not be disqualified from driving, and you must not know of any reason that would stop you driving legally on a public road.
- Every participant needs a basic level of fitness. You must be able to climb into and out of a high vehicle without help, and to walk on loose, slippery and uneven ground.
- You must tell us before the day about any physical or mental condition, injury, medication or disability that could affect your ability to drive, your alertness, or your access to the vehicle or the site. We will make any adjustment we reasonably can. Some conditions may mean you cannot drive; if we cannot safely accommodate you and you told us in good time, we refund what you have paid.
- If you are pregnant, tell us before the day. Off-road driving involves jolts and side loads; we will talk it through with you.
- We may refuse to let anyone drive, or continue driving, if we believe they are unfit, unsafe, or not meeting these terms. No refund is due in that case.
5.Alcohol and drugs
- We operate a zero tolerance policy. No participant or spectator may be under the influence of alcohol or drugs at any time during an event. That includes anything consumed before you arrive.
- If we believe anyone is under the influence, they will not drive or ride in a vehicle, they may be asked to leave the site, and the booking is forfeited without refund.
- Prescription medication that affects driving counts. Tell us in advance.
6.On the day
- Be at the meeting point 10 minutes before the start time on your booking. The booked time includes the drive from the meeting point to the site and back, about 15 minutes each way. Experience day drivers travel to the site with the instructor. Spectators make their own way to the assembly point and we send directions with the booking confirmation.
- Before anyone drives, every participant must read and sign our participant disclaimer. A parent or guardian signs for anyone under 18. If you refuse to sign, you cannot take part and no refund is due. You can read the disclaimer in advance: ask us and we will email it.
- Our instructor is in charge on the site. You must follow their instructions and the site rules at all times, drive only where and how you are directed, wear your seatbelt, and keep to the speed and route the instructor sets. This is not a competition. Nobody is timed or scored.
- You can stop at any point and opt out of any section. Tell the instructor and they will get you out safely. No refund is due for time you choose not to use.
- If a participant ignores instructions, behaves dangerously, or is abusive to staff, other participants, spectators or the public, we will end their session and may ask them to leave the site. No refund is due.
- Dress for the outdoors. A warm layer, a waterproof, and sturdy closed footwear. Open-toe footwear is not allowed on site. We drive in most weather.
- You are responsible for your own belongings on the site. Mud, water and vibration are part of the day; keep phones and cameras somewhere safe.
- You are responsible for any fine or charge that results from something you do against or outside our instructions.
7.Spectators
- Spectators are welcome and there is no charge for them. Tell us how many are coming when you book, up to four per booking. Larger groups need our agreement in advance.
- On arrival, every spectator signs in at the quarry assembly point, receives the same safety briefing as the driver, and signs the disclaimer. A parent or guardian signs for a child.
- Spectators must stay where the instructor puts them, must not walk onto the course or near a moving vehicle, and must follow the instructor's directions at all times. Children must be supervised by an adult who is not driving. A working quarry is not a public park: there are moving vehicles, loose ground, drops and machinery, and spectators attend at their own risk.
- We can ask any spectator to leave the site if they do not follow directions. The booking continues without them.
- Spectators are also bound by section 5 (alcohol and drugs) and section 16 (photography).
8.Passengers
- Our Land Rover currently has two seats: the driver's and the instructor's. Passengers are not available at present. When they are, the following applies.
- A passenger is a participant and must sign the disclaimer, follow the instructor, wear a seatbelt and meet the fitness requirement in section 4.3.
- Young passengers aged 12 to 17 (inclusive) and over 1.5 metres tall may ride only with a parent or guardian's written consent, given by signing the disclaimer on their behalf. The parent or guardian is responsible for the child's conduct.
- Children under 12, or under 1.5 metres tall, may take part only by prior special agreement with us, and must be accompanied by a parent or guardian at all times on a one-to-one basis.
- Where a passenger fee applies, it is shown on the booking page and is part of the booking total.
9.Changing your booking
- You can move an experience day to another available date at no charge if you ask in writing more than 14 days before the booked date. We will do our best to find a date that suits, subject to availability.
- A change requested 14 days or less before the booked date is treated as a cancellation, and section 10 applies. We will still try to help where we can, but we cannot promise to.
- If you change to a session that costs less, we keep the original deposit in full. If you change to one that costs more, the extra is added to your balance and we may ask for an additional deposit.
- For team days and training courses, the same 14-day rule applies to the date. Delegate numbers can go up subject to space; if numbers go down and our costs do not, we may invoice the full quoted value. We may charge an administration fee for changes to a confirmed quote.
- All changes must be requested in writing to info@allterrainacademy.com and are only agreed once we confirm them in writing.
10.If you cancel
- Tell us in writing as soon as you know. The date we receive your email is the cancellation date.
- More than 14 days before the event: you lose the deposit. Nothing else is due.
- 14 days or less before the event: the full value of the booking is due. If the balance has not yet been paid, we will invoice it.
- Cancelling because of your own illness, travel disruption, weather you do not like, or a change of plans counts as a cancellation by you. If you think you might need to, consider travel or event insurance.
- A voucher holder who books a date and then cancels is subject to the same rules. At 14 days or less the voucher is used up.
- Cancelling a gift voucher order: you can cancel for a full refund at any time before we issue the voucher. Once the voucher has been issued, section 14 applies.
11.If we cancel
- We may cancel or cut short an event because of weather, site conditions, a vehicle fault, instructor illness, loss of site access, or anything else that we decide makes it unsafe or impossible to run. We make that call; the site is a working quarry and conditions change.
- If we cancel before the event starts, you choose either a new date (subject to availability) or a full refund of everything you have paid us for that booking, including the deposit.
- If we have to stop an event part way through for safety, we will offer a date to complete the remaining time, or a fair pro-rata refund, at our discretion.
- That refund or new date is the whole of what we owe you. We are not liable for travel, accommodation, time off work or any other cost you incur because an event was cancelled or moved.
- We will tell you as early as we can, by phone and email, using the details on your booking. Keep them up to date and check your email on the morning of the event.
12.Late arrival and no-shows
- Sessions run in fixed blocks and another driver may be booked after you. If you arrive late, your session is shortened by the time you missed. It is not extended and no refund is due for the lost time.
- If you have not arrived, and have not contacted us, within 30 minutes of the start time on your booking, we treat the booking as a no-show. That is a cancellation by you inside 14 days: the full value is due and no refund is given.
- If you are running late, call 07624 406952. We will do what we can.
13.What is included
- An experience day includes the vehicle, fuel, an instructor beside you throughout, a safety briefing, use of the site, and the time in the driving seat shown for the session you booked (60 minutes, two hours, or three hours). The drive between the meeting point and the site, about 15 minutes each way, is included in the slot you book but is not part of the time in the seat.
- Team days and training courses include what your written quote says. Lunch is provided on full-day training courses only.
- Nothing else is included unless we agree it in writing. Bring your own food and drink for experience days.
14.Gift vouchers
- A voucher is valid for 12 months from the day we issue it. The expiry date is printed on the voucher. The session must be taken, not just booked, before that date. We do not extend expired vouchers except at our discretion.
- A voucher is for the session named on it. It has no cash value, cannot be exchanged for cash, and no change is given. It can be used for a session of higher value by paying the difference.
- The voucher can be given to anyone, but it cannot be sold or resold. Only one session can be taken per voucher, and the voucher is used up once the session has started.
- The person who uses the voucher must meet all the driver requirements in section 4 and is bound by these terms. If they cannot drive (for example, no full licence), the voucher can be passed to someone who can.
- The voucher code is the voucher. Keep it safe. If it is lost, the original purchaser can ask us to reissue it to the email address they ordered with; we will do so once we have verified the order. We are not responsible for a voucher used by someone who obtained the code from you.
- To redeem, the recipient uses the voucher redemption form, calls or emails us with the code and a preferred date. We check the voucher and availability, then confirm the booking by email. Dates are subject to availability; do not leave it until the last week of validity.
- If a voucher session is cancelled by us under section 11, we extend the voucher or offer a new date. If it is cancelled by the holder, section 10 applies and the voucher may be forfeited.
- Voucher orders are not refundable once the voucher has been issued, except where the law requires it.
15.Damage
- Off-road driving is hard on vehicles, and normal wear, mud and minor scuffs are our problem, not yours.
- If a participant damages our vehicle, our equipment, the site, or anyone else's property by wilfully disregarding the instructor's instructions, or by dangerous or reckless conduct, that participant (and, where they booked for them, the person who made the booking) is liable for the reasonable cost of repair or replacement, plus loss of use while it is off the road.
- On a training course or bespoke event using your own vehicles, your vehicles remain at your risk and under your insurance.
16.Photography and marketing
- We sometimes take photos and video during events. We may use them on our website, social media and in printed material to show what we do.
- Where you are recognisable, or where the material includes a child, we will only use it with your (or the parent or guardian's) express permission, which we ask for on the disclaimer.
- You can opt out at any time, before, during or after the event, by telling the instructor or emailing info@allterrainacademy.com. We will not use, or will take down, anything you ask us to, as far as is practical.
- You are welcome to take your own photos from the assembly point. Filming from inside the vehicle is at the instructor's discretion and you must not hold a phone or camera while driving.
17.Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us exclude.
- Off-road driving has inherent risks. Vehicles tilt, slide, bounce and occasionally get stuck, and the ground is uneven. By taking part you accept those risks, and you accept that you share responsibility for your own safety and for the safety of others by following instructions and behaving sensibly. This does not remove our duty to run the event with reasonable care.
- We accept liability for death or personal injury caused by our negligence or our breach of a legal duty.
- Apart from that, our total liability to you for any booking, whether in contract, negligence or otherwise, is limited to the amount you paid us for that booking.
- We are not liable for loss or damage to personal property, for indirect or consequential loss, for loss of earnings, or for any loss that arises from a participant's or spectator's failure to follow these terms or the instructor's directions.
- We are not liable for anything outside our reasonable control, including weather, site closure, road conditions and the acts of third parties.
- If you booked on behalf of others, you are responsible for making sure they know these terms, and you agree to cover us for any loss caused by their failure to follow them.
18.Your data
- We collect and use your personal data to run your booking, to meet our legal obligations, and, only if you ask us to, to send you marketing. How we do that is set out in our privacy policy, which forms part of these terms.
- We keep a record of your acceptance of these terms (date, time, version and network address) as evidence of the contract.
19.Complaints
- If something goes wrong, tell us on the day if you can, so we can put it right there and then.
- Otherwise email info@allterrainacademy.com with your booking code within 14 days of the event. We acknowledge complaints within two working days and aim to give you a full reply within 14 days.
- We are a small company and we would much rather fix a problem than argue about it.
20.The legal bits
- These terms, your booking confirmation, your quote (for team days and training) and the participant disclaimer are the whole agreement between us for the event. Anything said in conversation that is not in writing does not form part of it.
- If any part of these terms is found to be unenforceable, the rest still applies.
- If we do not enforce a term on one occasion, we can still enforce it later.
- We may update these terms from time to time. The version you accepted when you booked is the one that applies to that booking. The version number is at the top of this page and is stored with your booking.
- These terms are governed by the law of the Isle of Man, and any dispute will be dealt with by the courts of the Isle of Man.
- Nothing in these terms affects the rights you have as a consumer under Isle of Man law.
